SCOPE & CONTENT:

Letter from John Armstrong, magistrate, to William Gregory, Under Secretary, seeking legal advice if he and his fellow magistrates have over stepped the limits of their duty in allowing bail to William Irwin, who was accused by Bridget Costello of robbery and having beaten her. Adding that Irwin, is the bailiff who secured the eviction of Costello, who was Armstrong’s tenant. Stating that Costello and her husband were evicted ‘in consequence of their base conduct and character’ by making the false allegation against Irwin, ‘a man of excellent character’. Also letter from Gregory, to William Plunkett, Attorney General, including annotation from Plunkett that the magistrates must exercise their own discretion.

Letter from Thomas Williams, Chief Constable, to Sir John Burke, recommending that evidence be taken from a man named Sheridan, whose life is in danger having sustained a severe beating; making arrangements for the inquest and noting that there have been three murders in one week. Also letter from John Burke, addressed ‘My dear Colonel’, stating that he cannot get the coroner and local magistrates to initiate inquests into the murders, including the murder of Donnelly on [?William Nugent] Lord Riverston’s estate. Adding that there appears to be noting political in the murders. Also covering letter from Matthew Shawe, Hillsborough, [County Down], to William Gregory, Under Secretary, noting that he has instructed [Burke] to submit regular reports of cases of this nature.

Letter from [William Beresford, 1st Viscount] Beresford, Curraghmore, [County Waterford], to William Gregory, Under Secretary, writing on behalf of Lord Waterford who has reason to complain about the recent violent breaches of the peace which effect the interests of his family and confirm to the ‘lower orders’ that the system of intimidation now being practiced will be preserved; drawing attention to the outrages which have occurred on the mountain of Slievegrine; claiming that the law officers of the crown should investigate the actions of Mr Stuart and Mr Baron; observing that the most efficient manner to ensure the submission of the people to the law is to enforce penalties against the higher classes who break the law. Also memorandum containing comments from Gregory, Richard Wellesley and including legal opinion of Henry Joy, [Solicitor General], advising that if Wellesley were to interfere it would be to recommend a prosecution against both parties.

Letter from Rev John Kinahan, perpetual curate of Feakle, Feakle, [County Clare], to Maj Warburton, Inspector General of Police, noting that an informer has offered, if compensated, to reveal the whereabouts of James Morony who is accused of the murder of Charles Callaghan of Mount Shannon, County Galway; noting that the murder occurred at Scariff, [County Clare] two years previously. Also copy of the inquest into the murder which occurred at the fair at Tomgrany, including the testimony of John Touhy of Scariff, William Noonan, Margaret Gale alias Ryan, Francis Grady, David Flannery, Jane Fletcher, James Haran, Bridget Haran, John White, Thomas Farrell, Anne Flannery, Mary [Hackett], John Flanagan, James Flannagan, Martha Callaghan, Patrick Harran, Patrick Dwyer, Walter Markham; also testimony of Lieutenant Lennon, 4th Revenue Corps who hinted that the motive for the attack was orangeism.

Letter from [William Beresford, 1st Viscount] Beresford, Armagh, to William Gregory, Under Secretary, concerning that outrages which occurred on Slievegrine and the worry that those who come out to vote for Lord George Beresford will be in danger; noting that Mr Stuart is to try the question of his rights at the ensuing assizes but that Lord George Beresford and his supporters have nothing to do with this; adding that under the decision of government, as communicated to him recently, ‘the offending and offended parties are left undistinguished and are to be treated precisely as if both were offenders equally’.
