Letter from Charles Burton, engraver and printer, [Dublin], to Henry Goulburn, Chief Secretary, Dublin Castle, drawing attention to his lack of resources and requesting a post of employment under government. Asks that a reply be directed to him care of Mr Fitzpatrick at the office of the 'Patriot' newspaper [College Green, Dublin]. Also letter from Burton to Goulburn, asking that a certificate of character [previously enclosed] provided by Reverend Dr Charles Molloy, Church of Ireland rector of Clontarf, County Dublin, be returned; also second note from Burton to Goulburn repeating his appeal for return of his document.

Letter from William Kemmis, crown solicitor, Dublin, concerning the imposition of a fine on Thomas Montgomery, magistrate, of Mitchelstown, County Cork

SCOPE & CONTENT:

Letter from William Kemmis, crown solicitor, Treasury Chambers, Dublin Castle, to Henry Goulburn, Chief Secretary, Dublin Castle, reflecting upon an appeal over a fine of Stg£50 imposed on Thomas Montgomery, magistrate, of Mitchelstown, County Cork, by Robert Torrens, circuit judge, at the assizes of Limerick, for failure to come before the assizes to explain why he committed Edward Fogarty to gaol without good cause. Conveys opinion of the lords of the treasury that while the fine was imposed in accordance with legal protocol, it may not be necessary to insist upon payment. Remarks the issue should be placed before the law officers of the crown for consideration. Also copy of case on behalf of the crown in which the substance of the matter is discussed and opinion given by the Attorney General of Ireland [William Conyngham Plunket]. Provides an outline of the charge against Fogarty, a weaver, and his wife, for allegedly setting fire to turf on the bog of Ballylanders [the property of Darley Luddy of Spittle in County Limerick], in early September 1824. Acknowledges the tentative nature of the evidence offered by Montgomery against Fogarty, and the failure of the former to appear before Torrens to explain his actions; also notes Montgomery’s explanation for failing to appear at the assizes or subsequently, on account of his managerial responsibilities as land agent to George King, 3rd Earl of Kingston, County Cork. Records view of Plunket on base in which he observes the case contains a number of abnormalities and stresses the nature of the fine imposed by the circuit judge ‘is illegal, & ought to be discontinued’.

SCOPE & CONTENT:

Letter from Major George Warburton, inspector general of police for Connaught, to William H Gregory, Under Secretary of Ireland, Dublin Castle, drawing attention to the need for a regular set of instructions on how police patrols are to act if faced with unlawful parties whilst on night duty. States he was assured by Henry Goulburn, Chief Secretary, that a representation on the matter would be made to the Attorney General of Ireland [William Conyngham Plunket]. Also copy of draft response in hand of John Sealy Townsend, King’s Counsel and legal advisor to the Chief Secretary’s Office, indicating that constables on night patrol may disperse any armed or unarmed parties encountered at night. Such parties may be apprehended and brought before a magistrate, who may exercise powers of committal; the constables, however, are not entitled to kill the prisoners but may answer force with force.

4 letters from Francis Heath, late lieutenant colonel, royal Leinster provincial regiment, Portumna, County Galway, to Henry Goulburn, Chief Secretary, Dublin Castle, complaining of distress and requesting a measure of financial assistance from government. Acknowledges the past assistance of government and complains of the fiscal pressures of keeping a wife and 9 dependant children, all of whom are in need of the necessities of life. Expresses dread at the prospect of being unable to meet the forthcoming half year’s rent, which will likely lead to the loss of his two cows, 6 November 1825. Having so little by way of personal income, he asks, if one or both his eldest boys can be accommodated in a government school in Dublin, 11 December 1825. States he has another son living near Celbridge, County Kildare, whose living allowance has not been paid; claims his son remains a ‘hostage’ and he as father is subject to legal action for the recovery of arrears, 8 January 1826.

Letter from Henry Hobhouse, Under Secretary of State for the Home Department, Whitehall, London, to Henry Goulburn, Chief Secretary, Dublin Castle, transmitting for information details of a complaint made by Mr A Campbell against Bertram Mitford [a commissioners of the Board of Inquiry, Dublin], concerning an issue in connection with a manor court over which Mitford acts as seneschal [not present]. He states the information was referred to Robert Peel, Secretary of State, by Joseph Hume, MP for Aberdeen, Scotland, and the former asks that it be conveyed to the Chief Secretary of Ireland ‘to ascertain the true nature of the case’.

SCOPE & CONTENT:

Letter from Eliza Eyre, Rathcormac, County Cork, to Richard Wellesley, 1st Marquis Wellesley, Lord Lieutenant, Dublin Castle, complaining of the loss of a letter containing a £5 note transmitted to Mr Anderson, agent to the British Insurance Company, Clonmel, County Tipperary. Remarks she has lost confidence in the post office who were unable to ensure the safety of her letter ‘between two post towns…without being plundered’. Asks that the lost money be refunded by government as the family are ill equipped to bear the loss. Encloses letter from Sir Edward Smith Lees, secretary, General Post Office, Dublin, to Paul Eyre, Rathcormac, expressing regret over the loss of the sum and indicating no trace was found in the subsequent investigation. With printed form on reverse containing instructions to the public if sending notes or drafts through the post: advises to cut the notes in half and ‘send them at two different times’.
