SCOPE & CONTENT:

File of papers relating to complaints respecting treatment of jurors summoned to quarter sessions, Cork. Includes letter from Andrew MacAuliff, Cork, County Cork, to Henry Goulburn, Chief Secretary, Dublin Castle, highlighting the need to investigate the administration of justice 'that has been adhered to at the Sessions for the County of Cork, and which has been so long & so loudly complained of', 6 September 1823. Encloses a petition from members of a jury at the recent quarter sessions held at Cork, for the county's East Riding, to Richard Wellesley, 1st marquis Wellesley, Lord Lieutenant, Dublin Castle: refers to the circumstances of their being summoned to attend as jurors, to hear a charge against Robert Vivian and John Rutledge Majenide, both officers of the 22nd regiment of foot, for an assault on John Shinnor. Complains of their treatment, and their being 'locked up in their [deliberating] room, without even Candlelight…', after having reached their decision, owing to the absence of a court official to hear their verdict and discharge them. Also complains that those involved in the case were permitted to verbally abuse them 'which the Court did not notice or Check'. In particular, complains of their treatment at the hands of the assistant barrister for the East Riding of Cork. Petition signed by 10 jury members, including MacAuliff, their foreman. They also enclose an extract from 'The Southern Reporter' newspaper, reporting at length on the details of the trial. File also includes letter from Samuel Hobson, Mallow, County Cork, assistant barrister for the East Riding of Cork, to Goulburn, responding, as requested, to the complaints made in the petition, and offering a very different account of proceedings. Emphasises that the delay resulted from the jury's inability to reach a unanimous verdict. Hobson complains that, 'those ten complaining Jurors have pursued me with the most malignant rancour by grossly misrepresenting the whole occurrence'. He adds that, 'The Under-Sheriff has been greatly to blame for selecting such a Set of Men, chiefly Tradesmen, for the important duty of Jurors of the County…', 19 September 1823; with subsequent annotations on reverse of Hobson's letter, by Wellesley, and by William Conyngham Plunket, Attorney General of Ireland. SCOPE & CONTENT:

Letter from Francis W Small, Glenarm, County Antrim, half pay lieutenant of New Brunswick regiment, to Lieutenant General William Fyers, commanding officer of the Royal Engineers, Office of Ordnance, Dublin, referring to his [Small's] former application for employment in the Ordnance department, and detailing his circumstances. Refers to his service in Canada with Colonel John BR O'Neill, MP for County Antrim, and to his application to O'Neil's brother [Charles O'Neill, 1st earl O'Neill, joint Irish Post Master General], for employment as a local postmaster. States that he has relocated his family to County Antrim, whilst awaiting appointment, and seeks a loan of £5 to purchase furniture, until his next army half-pay, 10 February 1823; Small encloses copies of a letter from Colonel John O'Neill, London, to Small, at Killough, stating that his name is noted for appointment to a job with the Post Office, 6 June 1822; and also a copy of a testimonial from Colonel Pearson, commander of the 23rd (Royal Welch Fusiliers) regiment of foot, concerning Small's conduct, 17 June 1822. Also note by CSO official stating that these papers were 'given me by H:C 16 December [1823]'.

Copy of petition of Sir Eyre Coote, requesting to purchase reversion of crown lands in Queen's County [Laois]

SCOPE & CONTENT:

Letter from John Hawkesworth, 63 Leeson Street, Dublin, to Henry Goulburn, Chief Secretary, Dublin Castle, 10 December 1823, enclosing copy of a petition from Sir Eyre Coote, submitted in July 1823, to the Lords of the Treasury, London, requesting to purchase the reversion of the crown lands near Maryborough [Portlaoise], Queen's County [County Laois]. The petition details the title of the lands in question - the mill and lands of Great and Small Buress, 'the Land called Clooneribble' and Curriers Bog, 'containing in all Six hundred Acres': refers to a patent granted to Arthur St. George of Athlone, County Westmeath, in the reign of Charles II; the lands were in turn granted to St. George's cousin, Charles, 6th earl of Drogheda, and later transferred from the Earl of Drogheda (by then Marquis of Drogheda), to Sir Eyre Coote in 1802, for the sum of £18,000. Coote emphasises that the lands are near Maryborough, 'and that it will be highly beneficial to the said town that your Memorialist [Coote] should be enabled to make freehold leases for lives renewable for ever… in order to encourage Building in the said Town'. Annotation on copy petition by 'HH', Vice Treasurer's Office, Dublin, 10 December 1823, states that it was originally forwarded to the Lords Commissioners of the Treasury on 25 July 1823. Also 2 letters from John Barry Maxwell, 5th baron Farnham; and Harstonge Robinson, Crown Land Office, Treasury Chambers, Dublin, commissioners of crown lands, to Goulburn, reporting, as requested, on their actions taken in respect of Coote's application, and offering their approval for the proposed purchase, and recommending the amount to be paid, December 1823; 22 December 1823.

SCOPE & CONTENT:

Letter from Thomas Croke, Cove [Cobh], Cork, Roman Catholic chaplain to the convict hulk 'Surprize' moored at Cove, to Henry Goulburn, Chief Secretary, Dublin Castle, emphasising the duties involved in his role as chaplain, and requesting an increase in his salary. Refers to the additional work and hardships compared with a conventional jail chaplaincy: '….Sea, and storm are to be encountered in visiting a depot a float, together with the great loss of time in making a Signal that is not quickly caught by the eye of the sentinel, and then waiting the arrival of the ship's boat…', 3 December 1823; with subsequent annotation on reverse by Goulburn. Also letter from Dr Edward Trevor, superintendent and medical inspector of convicts, reporting, as requested, on the salaries and duties of the Protestant and Roman Catholic chaplains attending the hulk, and those attending the penitentiary in Cork. Notes that once the hulk is established at Dunleary [Dún Laoghaire], County Dublin, to receive convicts from northern jails, the numbers of prisoners onboard the hulk at Cove will be reduced, 9 December [1823].

Copy of draft letter from Henry Goulburn, Chief Secretary, Dublin Castle, to Francis Needham, 1st earl of Kilmorey, referring to his consultation with the Navigation Board regarding a project submitted by Kilmorey, concerning the Newry Canal. Reports that the Lord Lieutenant, 'does not consider that he should be justified in acceding to the proposal of abandoning the profits now accruing to the public' from the tolls, in order to pursue an extension of the canal.
