Petition of Edward Gamble, druggist, Enniskillen, County Fermanagh, to Richard Wellesley, 1st Marquis Wellesley, Lord Lieutenant, Dublin Castle, requesting an enquiry into the conduct of local magistrates, Reverend John Augenleck and John Thomas Galbraith, following their refusal to take action against members of the Chittick family. Explains he received prior information about a threat made against him by James Chittick, who declared he had ‘a pistol charged’ in anticipation of using it for harm, but laments he could get no protection from the magistrates. Complains in August last [1825] he was ‘grossly assaulted’ by James Chittick, Anne James Chittick and Isabella James Chittick, and alleges the magistrates by failing to come to his defence in the matter ‘acted partially and corruptly’.

SCOPE & CONTENT:

Petition of Charles Newenham, city of Cork, County Cork, and Elizabeth Newenham, spinster, city of Dublin, to Richard Wellesley, 1st Marquis Wellesley, Lord Lieutenant, Dublin Castle, requesting that a claim by the crown to the sum of £710 10s 7d left in his will by their father William Worth Newenham, late of Coolmore, County Cork, be waived in their favour. Recites text of will in which their father places a total of £2,500 in the care of trustees, Thomas Newenham and Jacob Lemen, to be apportioned between his children Henry Newenham, Charles Newenham and Elizabeth Newenham, upon reaching the age of maturity. Indicates that their brother Henry Newenham has since died intestate and ‘without issue’, and they make claim for the sum of £710 10s 7d which is the remainder of his portion of £1,000, that has become vested in the crown. Adds that William Henry Worth Newenham, on whose estate the sums referred to in the will are raised, waives any right to the money. With attestation added to base from Charles Newenham, validating his claim to the sum left by his father, signed by applicants and sworn before Bartholomew Gibbings, mayor of Cork. With response on reverse by Henry Goulburn, Chief Secretary, Dublin Castle, indicating guidance should be sought from the Attorney General [William Conyngham Plunket] or the Solicitor General of Ireland [Henry Joy]; signed by Wellesley.

Letter from Edward Conolly, landlord, Ballyshannon, County Donegal, to Henry Goulburn, Chief Secretary, Dublin Castle, drawing attention to local unease over the introduction of replacement currency. He reports the Customs House in Ballyshannon has to date received only Stg£400 from the public to be exchanged for bank tokens and estimates a sum of £10,000 will be required in silver for the immediate neighbourhood. Remarks a rumour is put about that the bank tokens are ‘not worth their full value’ and observes, to ease the uncertainly, he is accepting the tokens in payment for rent.

Petition of James Brady, Tomgrany [Tomgraney], County Clare, to Henry Goulburn, Chief Secretary, Dublin Castle, complaining of the failure of the magistrates at petty sessions to act against those who forced him off his land. Asks for a full investigation of the matter. Recalls on 22 August he was accosted by a violent party under the leadership of Dennis Dinan and Matthew Dinan, who ejected him from his holding on the estate of Lord Dunboyne [James Butler]. States he was in possession of the farm for a period of 5 years.

Report by John Sealy Townsend, King’s Counsel and legal advisor to the Chief Secretary’s Office, on a claim to compensation by the usher of the Court of Exchequer in Ireland [Charles Fleetwood, usher, equity side of the Court of Exchequer]. Gives full consideration to the case at issue and remarks the criteria resorted to by the legislature in settlement of the claim is fair. With comment added beneath [at a later date] by Townsend acknowledging a recent ruling on the matter of the payment of recompense to other officers of the court; admits that Fleetwood is entitled to some financial consideration but remarks he is ‘unable to say out of what fund it ought to come’. Also note on reverse in different hand [likely from a senior law officer] with observation of the provisions of the law [especially the 1st and 2nd acts of George IV, chapter 53] in relation to compensation of officers of the court.

Letter from Colonel Daniel Toler Osborne, chief constable of police, Curristown, Killucan, County Westmeath, to Henry Goulburn, Chief Secretary, Dublin Castle, requesting disbursement of the sum of £4 5s 6d to cover a charge on his quarterly account for the month of September arising from the prosecution of three men for murder of a man named ‘Doyle’. Indicates the Attorney General [William Conyngham Plunket] decided against a crown suit in the case but he employed council and pressed charges against the offenders; notes that having secured a conviction two of those charged were transported for life and the third given a prison sentence of 12 months. Also letter from Osborne to William Gregory, Under Secretary, Dublin Castle, seeking issue of £5 4s 6d to cover a bill of legal costs appearing on his quarterly account for the month of December. States the sum was made in payment of Mr [James] Gunning for his work in a case against two men for manslaughter at the Mullingar summer assizes. Remarks an earlier application for settlement of his account for September has not received a reply from government.

Letter from Thomas Hunter, 61 Dawson Street, Dublin, to Henry Goulburn, Chief Secretary, Dublin Castle, seeking issue of remuneration for labours on transcription from the census returns of information on the townlands, parishes and land divisions of Ireland, as requested by the House of Commons. Complains despite various applications for settlement to William Shaw Mason [secretary of Records Commission], under who he undertook the work, he has not received payment as yet from government. Also cover letter from Hunter to Goulburn, enclosing a copy of the above letter seeking issue of compensation for labour. Annotation on reverse in reply from Goulburn states that no authority was granted for the work referred to. Explains that application for remuneration should have been made to the committee of the House of Commons who ordered the report, but that action being ‘omitted’ it will now rest on the discretion of the Treasury as to resolution.

Petition of James Hamilton, Cavan Gaol, County Cavan, to Richard Wellesley, 1st Marquis Wellesley, Lord Lieutenant, Dublin Castle, seeking intervention in order to secure his release from gaol where he is held following a theft in the town of Killeshandra. Explains he accepted the gift of £1 from some men he met in Killeshandra, County Cavan, but having later discovered a robbery had been committed or a man ‘lost money out of his pocket’ he presented the sum to the chief constable of police and gave information on those who had the money in their possession. Complains he is detained in jail since 11 August as a vagrant for he has no one to act in his support as a character witness, being 80 miles from home. States he was passing through Killeshandra on his way to the city of Belfast, where his wife and family of four children reside, in the hope of finding employment in his profession as a comb maker.
