Letter from James Kirby, Waterford County Gaol, to [Richard Wellesley], Lord Lieutenant, seeking an investigation into the circumstances surrounding his arrest by Sgt Lenehan, following the issuing of a writ from the King’s Bench. Annotation on reverse giving legal opinion of Richard W Greene, stating that if the facts outlined by Kirby are true, the arrest was illegally conducted and the sergeant should be punished, and recommending that he submit an affidavit to this effect to the King’s Bench.

SCOPE & CONTENT:

File of papers relating to a ‘Report of the Committee of Medical Practitioners appointed to enquire into the state of Fever in [Waterford] City and its Liberties’. Outlines the rapid progress of the illness and its prominence among the ‘poor and wretched’; suggests a number of causes for the epidemic: ‘Poverty, with all its attendant miseries… aided by a general and habitual indulgence to excess in the use of Spiritous Liquors may be attributed the prevalence of the present malady’; and recommends a number of actions to halt the spread of the contagion, as well as to address the dangers posed by the current system of disposing of ‘dung’ in the city. Includes report on numbers of patients admitted, discharged and deceased in Waterford Fever Hospital between 1 November 1826 and 30 January 1827, signed by [Michael Hearne]. Also letter from Henry H Hunt, Mayor of Waterford, Mayor’s Office, Waterford, to Henry Goulburn, Chief Secretary, stressing the urgency of the case and enclosing a copy of resolutions passed at a meeting of magistrates and medical practitioners to discuss the fever epidemic held at the Town Hall, 22 and 31 January 1826. States that Goulburn’s circular would take time to consider over the next 10 days or fortnight, and expresses his hope that he will excuse his delay in responding to him as he was required to attend a number of Road Sessions around the county, which will provide him with a good opportunity to gather information.

Letter from Thomas Stack, Omagh, [County Tyrone], to unknown recipient, enquiring further into a letter received from him on 30 December 1826 which stated that members of the constabulary force were to execute all warrants of civil magistrates except those relating to matters of rent, tithes, taxes or revenue laws, and seeking clarification on the issue relating to fishery and game laws, in particular, persons convicted for salmon fishing.
